A pregnant mother faces charges of ‘disorderly conduct’ and possible jail time because her three year old toddler urinated in a parking lot.

Brooke Johns said she was driving when her son, Cohen, said he needed to use the restroom.

“He’s like, ‘Mum, I’ve got to pee. I’ve got to pee!’ I was like, ‘Well, hold on,’ and he’s like, ‘No! I’ve GOT to pee! I’ve got to REALLY pee.’ ” Ms Johns told WRDW.

According to Ms Johns the two barely made it to a petrol station parking lot before she realised he wasn’t going to make it inside.

“I can’t pick him up,” Ms Johns said. “I’m not supposed to lift him.”

Ms Johns said she tried to cover up her toddler as best as she could as he relieved himself in the parking lot.

The commotion caught the attention of a Richmond County Sheriff’s deputy.

“Accidents happen. And he was like, ‘Take him in the bathroom.’ What if I would have run in the bathroom and someone had been in there? What I was going to let him do? Pee on the floor of the gas station?” Ms Johns said.

“She allowed her male child to urinate in the parking lot,” the deputy wrote on the citation. “I observed the male’s genitals and the urination. Public restrooms are offered at the location.”

If convicted, Ms Johns faces up to 60 days in jail and an AU$7,015 fine.

  • It does seem a very extreem reaction.
    At the same time I am a mum of 3 girls and I must say that boys peeing in public happens all the time where as you dont see this with girls. Is it that girls have better bladder control or is it that parents put in less effort with boys and feel like they dont have to panic as much as boys can just pee anywhere? Im really not sure but think about how many boys you have seen compared to how many girls…. big difference. So why is that?

  • How close were the toilets at the location? Jail is just ridiculous. Time and pay money wasted on insignificant issues when real criminals are out roaming about out there.

  • Wow, I do appreciate urinating in public is a criminal offence worthy of a fine… but in this instance I do really think there were extenuating circumstances. A warning would have sufficed.

  • This is utterly ridiculous! If the mother had of pushed the issue and made him walk to the toilet he may have wet himself anyway. It’s not like he’s an adult and what was the deputy doing looking at the boy’s genitals anyway. I think a little compassion is warranted.

  • I get where the Sheriff or county deputy is coming from but this mum is heavily pregnant and can’t carry him and he is only young so hasn’t got bladder control abilities that adults or older kids do. He needs to be juggling 3 kids to get a taste of what it is like in an emergency and not able to get to the toilet. This is why I will let kids ahead go ahead of me if there is a line up at the ladies loos.

  • By the wording, this isn’t in Australia. And living in a rural area, all my kids have done ‘bush pees’ until they were older and had better bladder control.

  • OMG Lock them both up. Seriously how pathetic is this. Adults urinate wherever they feel like and they might get slapped with a fine. This is just a young child who needed to relieve himself. Mum is pregnant and they’re talking about possible jailing her. What is wrong with the world we live in these days.

  • I’ve done this! 3 year olds can’t hold too long. I usually only let him go behind trees or something, and if there are no toilets.

  • Shocking treatment by the Deputy. I hope a judge throws it out as a vexatious complaint. As another said, he obviously doesn’t have children who need to go NOW.
