So ny hubby just got laid off at work & I am at home with our 3 year old & six month old. I was working full time before I went off on maternity leave, so hubby went back to work after being a full time stay at home dad. I rang ny employer to say I am thinking of coming back partime to start with as we need money…obviously. My employer stated that they don’t have to take me back until my six months us up & even then he doesn’t know if there will be a position for me with the way the company is going right now. I honestly thought I had more rights & was able to get my position back. I rang fairwork & apparently they can get rid of me with notice. Hubby has applied for many other jobs but there’s honestly not much out there unless you are a backpacker or someone who will work for less than minimum wage. Now we are literally in struggle town.

  • Sorry to hear – why do bad things happen to good people? Hopefully either you or your hubby can find something sooner rather than later. Your children obviously have two good role models for parents.

  • I also thought your job would be safe. Ring the Law Institute in your state and they might be able to point you in the right direction without too much of a cost to you.

  • I really thought that your position would be held open for you upon your return from maternity leave. I can understand if your employer is unable to make you part-time as this original position was full-time but not letting you return to full-time doesn’t sound right.

  • Are you a Union Member? They might be willing to raise a stink even if your employer is technically correct (and I’m not sure they are). Also, you may be able to complain to the Women’s Rights (not sure I have that title right) commissioner about discrimination. Not sure what their legal powers are, but they might be able to put the hard word on.

  • I always thought that your employer had to keep your position open for you to return to, if thats the case have you thought about you heading back full time and hubby staying at home with the kids until he can find something or until your in a better position with your company to go part time ??

  • My Daughter went through this fight after the birth of her first angel baby and fought for over 6 months to get her job back but gave up to try and have another baby at the time. It is so unfair she had in writing that she would go back to her position unless it did not exist but it did and they would not and women still do not get treated as fair as people think. Hope all goes well for your family
