A Queensland teenager is suing the government for more than $350,000 after he injured his knee during a game of touch rugby.

Dylan Luxton claims he fell and fractured his shin bone during the football game at Woodhill State School, west of the Gold Coast, in 2012, according to The Gold Coast Bulletin.

The 18-year-old, who claims his Dunlop Volleys contributed to his slip, has since undergone a knee reconstruction and said in court documents the injury has stopped him from fulfilling his dream of becoming a personal trainer, shares Daily Mail.

He is asking for $354,770.20 in compensation.

Documents also allege that ‘inadequate supervision’ by the school contributed to the injury.

‘[The school] failed to warn of the dangers of participating in touch rugby while wearing Dunlop Volley shoes which facilitated or added to the foreseeable risk of slipping while so participating,’ court documents lodged in Southport District Court said.

‘Prior to his injury [Mr Luxton] enjoyed football, basketball and rollerblading.’

The 18-year-old is no longer able to participate in such sports, the documents claims.

  • Surely he was old enough to know that the shoes he was wearing were not suitable They are not suitable for any sport played directly onto soil. Did his parents even know he was playing that sport?

  • If, as he claims, the shoes contributed to the slip -surely he was aware of the likelihood of this happening before the event …. being an avid sports player, he must have known what to wear and what not to wear ….

  • That is what you get from playing in inappropriate footwear. He is old enough to know the risks and he should have made sure he had on the appropriate footwear. I hope it gets thrown out of court to. Just another money grabbing exercise by someone who doesn’t deserve it because of his own stupidity.

  • *sigh* I hope this gets thrown out of court. He was old enough to understand the risks of playing in inappropriate shoes. What happened to common sense? Why does the school have to police every tiny thing that could potentially cause harm?

  • Sport, suing and responsibility needs to be looked at as their is personal risk and responsibility. Goodness I have so many injuries and the responsibility is mine – no suing – stuff happens.

  • Really ? The choice of shoes is ones own responsibility ! When you play (pro) sport you seek advise when buying shoes.

  • most people know that footy boots are around for a reason, it is idiots like this that ruin it for everyone else. Even getting kids into sports is too expensive because of the insurance costs these days

  • I really hope he gets a big fat nothing. Nobody forced him to play touch footy in dunlop volleys. He sounds like he needs to work on his own decision making skills.

  • Mmm… Did the school oblige him to wear those shoes? Or was it his choice? Because if it was his choice, as I suspect, I don’t see much ground for his claim. :-(
