A woman who found out her husband was abusing their daughter but did nothing to stop him will avoid jail time.
The husband admitted to his wife in mid-2015 that he had been abusing the child, the District Court of Western Australia heard on Tuesday, shares Daily Mail.
He was sentenced to seven years in jail for engaging in sexual conduct with a child.
The 36-year-old man molested his daughter from when she was seven to about 13 years old, and even filmed some of the abuse, the court heard.
The 40-year-old WA woman said she learned about the abuse after the husband ‘just blurted out’ to her that he had ‘molested’ their daughter, claiming he had not ‘hurt her physically’ and promising not to do it again, ABC reported.
The woman went on to tell her daughter to say no to her father and to tell her if it happened again.
On Christmas Day 2015, the child, who was then aged around 13, told a family member about the abuse. This angered the mother, the court heard, because she felt it would risk breaking the family apart, Perth Now reported.
Judge Troy Sweeney said the woman ‘utterly failed to protect her daughter’ and had ‘placed responsibility’ on the child to make the abuse stop.
However, Judge Sweeney said the woman should avoid jail time so that the child doesn’t lose both her parents.
‘You remain her mother and she needs you desperately,’ the judge said, according to ABC.
The woman was given a 12-month jail term but it was suspended for 18 months, with conditions including mandatory counseling.
