Hello!

I have returned to work after 12 months maternity leave. My boss sat me down on the first morning back and told me they wanted me to start an hour later and finish an hour later. I tried to bargain 30 mins either side and it was a flat ‘No’. I don’t know where I stand but these new hours are playing havoc with my life. Can they do this? I have worked my hours without fuss for 19 years.

  • It would be worth seeking advice but as long as your total hours are the same I think they can do what they like. It is their business. Best you can do is look for something else so you get out of there as soon as you can.

  • I see this is an old question. I can imagine this was an unpleasant situation. Were you able to resolve this with your boss ?

  • Pretty sure, from my personal experience, bosses can decide when they need you to works, how many hours and the number of shifts. Sorry

  • I would call HR and see if it can get changed and explain why you need to do this.

  • Best place to ring is work ombudsman as I think they should be able to help or free legal advice either legal aid or community centre type organizations. You’d think your boss would try and help you instead of make it harder.

  • Everyone should be able to negotiate and they need to check agreements for their workplace.

  • My hubby has a monthly roster where he works. His start and finish times are on these. But at the bottom it says “This roster is a work in progress and can change any time. Please be patient.” So he’s rostered to work til 2.30 but never finishes at that time

  • The reason should be explained to you in detail. Speak with HR and also your union and find out your rights.

  • Speak to your HR department or if you have a union rep maybe speak to them

  • yeah you probably need to add more info

  • Oh I would go to HR and find out the reasons behind this. If it is not what is on your contract it isn’t right.

  • See your union!

  • how did this work out for you? did you have to do the new hours or?

  • seems strange – was there a reason given for the change? do you have a contract?

  • I guess they can do what they want

  • I would talk to fair work Aus and see where you stand, so many things are constantly changing in the work force

  • if you are a member of a union I would advise you to contact them, but pretty much if they set hours, and wont negotiate, there is not much you can do

  • First port of call is your union. Then fair work aus

  • Were you given a good business reason for it? Were you able to negotiate to swap hours with another employee? It doesn’t sound very family friendly. I agree with others, if you’re a member of a union, contact them. Or, ring your HR section if your company has one. Hope it all works out.

  • Speak to your union, I don’t believe it is fair but not sure what the official rules are.
