Hello!

Hi, I have tried to look for this information for a rental in QLD. We recently moved into a house and have been woken up quite often by noises in the wall behind our bed. Scurrying and scratching – we believe are rodents. I asked the Property Manager about it last month, and she did not respond. I asked again last weeks and her response was for us to put baits in the roof, as that is all their pest man will do… However, we are not wanting to pay for baits, and then the removal of dead animals if it is the responsibility of the landlord. When I asked her who’s responsibilty it was, she completely ignored the question. As I said previously, we believe the rodents were here before we moved in, as we are very clean tenants, and have only been here a short time.

  • Is there an Tenants Advisory Body or equivalent in Queensland? They should be able to offer you advice about your rights and responsibilities and how to enforce them.


  • It’s really difficult to answer this one as rules change quite a big from state to state. I think it’s really rude that the property manager ignores you though. Thatswhat they’re there for, to help you out. So rude!!!


  • There’s a tenants union here in Tas. We use rodent baits but have no issues with having to remove dead animals


  • We have a tenants union here, where you can go and ask these types of questions. They’re free and offer great advice, they know what they’re doing and have helped us a couple of times in the past


  • It should be the owners responsibility. I would speak to the agent again and tell them you might go to the tribunal and ask them for some advice. Once you mention the tribunal i think they might get onto it


  • In Victoria this is the tenants responsibility. It is only the landlords responsibility to seal any holes you may find that are allowing them to get in, or any rubbish that may have been hidden under the house. It doesn’t matter how clean you are, the roof is a nice warm place for them to nest.


  • Depending on where you live it could be possums. They will squeeze through the tiniest gap. We had them in the ceiling in an office I worked in. There was some big trees a few hundred metres away. They had to run across a busy road to get there too – probably at night. Their wee was coming through the ceiling.


  • Im a PM in SA and if they were there prior to you moving in it is Landlords responsibility


  • I would think it’s the landlords responsibility. Don’t put baits out as the rodents might be killed and remain in the wall or ceiling, then you’ll have a very stinky problem. good luck.


  • I think this falls to the landlord. If you had just decided to put baits in without permission they would probably argue that you should have asked them first. If they want you to put baits in yourself that’s fine but ask them to reimburse you or to buy the baits and you can install them.


  • I agree that this sounds like the landlord’s responsibility and should be attended to. Keep following this up with the property manager until they do something about it.

  • i believe it is the land lords responsibility. you need to make sure you have it in writing and documented when you spoke to her and the outcome (ie. her telling you to do it etc)
    email is a good way as it is dated and you have hard copy. don’t do these things over the phone as it is hard to prove who said what. (this goes for any thing which could cause some dispute later on) The property manager is getting paid (a lot) to sort out these kinds of things that is why you pay for a property manager! Dont let her fob you off. Keep emailing and insisting that she the agent come and sorts it out.

  • I think it’s responsibility of the landlord, not yours. And I think you should go back to the Property Manager and demand they get it fixed. Can’t you check the contract? I remember that when we rented in NSW there was a part stating that if the owner didn’t solve the problem in a reasonable time, the tenant could hire someone to do the job and then send the bill to the owner, or deduct the bill from the next rent.


  • Do not know the answer. Maybe make contact with a renting rights association? Best to address the problem as soon as possible. Good Luck.


  • Definitely don’t want baits. Traps are much better. I would put it inwriting


  • I am paying off the house we live in, but that doesnt matter in the point im going to make.. We made the mistake of putting baits out.. Yeah the mice/rats ate it but they died in the roof and rotted to the point the smell came through the house in warmer weather.. It took my hubby about 30 minutes of digging around in the roof removing the batts etc to look under them for the dead bodies.. I know it sucks and time consuming but if you get them to do the job it sounds like they will lay bait.. My suggestion is to use traps near the man hole and check every day.. Yes you might have a case against the land lord but the annoyance to you might not be worth it.. The smell will make you sick to the core.. more annoying than the sound of them running around in the walls.. We seem to get a few them every year no matter how clean we are inside.. Also take a peek over the fence in the neighbour’s back yards to see if that’s where they are coming from.. I suspect for us that is the cause they never mow the weeds are waist high and they get a person in once a year with a front end loader to scrape it out… then we get the pests… Goodluck and lets us know the result if the land lords do anything…
