Australian of the year and anti-domestic violence campaigner Rosie Batty is stunned and totally gutted by the downgrade to manslaughter to Gerard Baden-Clay’s previous murder conviction.

In a recent interview with ABC news, Rosie explained her strong feelings to the decision, “I just can’t believe it – and I don’t know whether I should say so or not – I just cannot believe a history of violence that’s very clear can be appealed and made to be manslaughter.

It absolutely sends the same message that I’m saying all of the time, that we undermine, disregard a victim in a violent relationship,” said Rosie, “Why is it so hard to believe when there is a history of violence that that murder is not intentional?”

The decision to downgrade the verdict to manslaughter was made in the Queensland Court Of Appeal on Tuesday on the basis of a finding of no solid evidence of Bayden-Clay’s intent to kill his wife, Allison.

Baden-Clay is due to be re-sentenced next year.

  • Absolutely fully agree with Rosie’s comments on this issue.
    On one side all moral citizens are attempting to promote the negativities of domestic violence and wow amazingly our legal eagles are very meekly painting the opposite picture in society.
    In this instance the victim has endured sustained domestic violence over a long period of time wow!, and then when you add the abhorrant situation of a 3rd party having an affair with the Baden who? . Well definitely a motive for a planned murder here. I am definitely not a legal eagle but it all stacks up against Baden Who?. Pass him a tissue will you !!!!!

  • cant believe this case has be downgraded to manslaughter, this thing murdered his wife then took her and buries her else were. how can that not be pre meditated murder

  • Although the appeals system is frustrating when it’s clear beyond doubt that the accused is guilty, it also provides an avenue of hope for those who are sentenced incorrectly. Sometimes appeals work in favour of the victim – In the case of Oscar Pistorius, justice was not served in his original trial, and now he is being charged with murder (as should always have been the case) and hopefully his sentence will reflect his crime.

  • The justice system in this country is a big fat joke at times– from mediation which is a crock of you know what to murder, where they can get off lightly.

  • Unfortunately our legal system gives us the right to appeal and people usually get off or sentences downgraded on a technicality. I guess is depends how good your lawyer is at the end of the day. It is an appalling outcome, and sends a poor message to other domestic abusers. Advocates like Rosie just need to keep fighting the good fight and help & support victims of domestic violence & pray for change and better outcomes.
