Yesterday I had a migraine, couldn’t get myself out of bed and took the day off work however regardless felt something was different.

Today I arrived at work and was told by my Manager that my 2 day job was being advertised as a 5 day job next week and to re-apply on Seek. My manager went on to say that if I leave my out-sourced current contractor employment I would have a good chance as they will have to pay them out a few thousand dollars.

Is this legal?

  • Not sure, sounds dodgey to me tho. Have you got a workplace rights centre you can visit or call? I’ld be googling something like that for help. Why is he readvertising a position you’re already filling? Why not ask you if you would like to increase your days? You know how to do the job, I don’t get why they’re looking for someone new

  • Yes & no. If they have decided that the job needs to be full time & you are not available full time then they have every right to advertise. however it sounds like they have not discussed it with you.

    That being said, if you are a casual they sadly do not need to give you notice or reason to let you go, however immoral it is.

    To tell you to leave the organisation that contracts you out though is most likely illegal & I would be tempted to go back to that organisation & let them know what’s going on.

    Sounds like this company is trying to get rid of you & not have to pay the monetary consequences.
